Public Offer Agreement for the Use of the Telegram bot "Mod Assistant Bot".
The development team Mod Assistant Bot Team (the "Provider") publishes dispela Public Offer Agreement for the conclusion of a contract for the provision of informational na auxiliary services using the Telegram bot "Mod Assistant Bot".
1. Definitions
1.1. Bot — software hosted on Telegram under the name "Mod Assistant Bot" (@ModAssistantBot), designed to automate moderation, filter messages, na manage groups/channels.
1.2. User — an individual or legal entity that accepts the terms of dispela Offer na uses the Bot.
1.3. Client — a User who has added the Bot to their grup/channel na/or activated a paid subscription.
1.4. Services — provision of access to the Bot's functionality, including free na paid features.
2. Subject of the Offer
2.1. The Provider grants the User access to the functionality of the Bot under the terms set forth in dispela Offer.
2.2. The User agrees to comply wantaim the terms of use na, for a paid subscription, to renew it in a timely manner.
3. Procedure for Concluding the Agreement
3.1. Dispela Agreement is concluded in the form of a Public Offer.
3.2. Acceptance of the Offer means:
- launching the Bot in a private chat (pressing the Start button);
- adding the Bot to a Telegram grup or channel;
- activating a paid subscription via integrated payment systems.
3.3. From the moment of acceptance, dispela Agreement is considered concluded.
3.4. The User confirms that they have reached the age required to independently enter into an agreement (but not less than 13 years of age).
4. Terms of Service Provision
4.1. The Bot's functionality is provided according to subscription tiers described on the official website na/or in the Bot's interface.
4.2. Subscription tiers may be free (Trial or Free) or paid (Start, Basic, Gold, Pro, Ultra, Titan, Max).
4.3. Paid services are provided only after successful payment.
4.4. Services are considered rendered from the moment the subscription tier is activated.
5. Pricing na Payment
5.1. Current tariffs na subscription durations are published on the website na/or in the Bot's interface.
5.2. Payment is made online via Telegram Payments or other connected gateways. Refunds are not provided after payment, except as required by applicable law.
5.3. The Provider does not store the User's bank card details — processing is carried out by third-party providers in compliance wantaim PCI DSS.
6. Rights na Obligations of the Parties
The Provider undertakes to ensure access to the Bot (except during maintenance), promptly fix errors na update the Bot, na ensure the security of personal data.
The User undertakes to use the Bot for its intended purpose, not disrupt the platform, na not use the Bot for illegal activities or spam.
7. Liability of the Parties
7.1. The Provider is not liable for failures of the Telegram platform, payment systems, or third-party services.
7.2. The Provider's liability is limited to the amount paid for the current subscription period.
7.3. Under no circumstances shall the Provider be liable for indirect damages, loss of profits, or data loss.
8. Intellectual Property
All rights to the Bot, its source code, design, na logos belong to Mod Assistant Bot Team. Copying, reverse engineering, na modification are prohibited without written permission.
9. Term na Amendments
Dispela Offer enters into force upon publication na remains valid indefinitely. The Provider reserves the right to amend it; continued use constitutes acceptance of the new version.
10. Governing Law
All disputes shall be resolved through negotiation; if no agreement is reached, in accordance wantaim the rules of the Telegram platform.
